General terms and conditions for online sales

BB Education operates www.bb.ca. The present contract is a legal agreement between you («Buyer») and BB Education (bb.ca/en/home).

Please read the terms and conditions of use carefully before accessing and making purchases on the bb.ca site.

1. INTRODUCTION

By using the bb.ca Web site, you agree to comply with all applicable laws and to be bound by the present contract for as long as you use the site. You recognize that you have read and understood these conditions. If you do not wish to be bound by these terms and conditions, please do not use the bb.ca site.

2. PROFILE USAGE

If you have an account and are connected to it, you are responsible for keeping your identity and password private. By using the bb.ca Web site, you agree to be liable for all transactions made under your account using your password. Should the confidentiality of this information be compromised, you must notify our office as soon as possible to avoid possible fraudulent use of your account. BB Education will not be held responsible for any loss or damage that the proper security measures outlined in this section could have prevented.

3. EXCHANGE AND REFUND

Products sold by BB Education’s are new and guaranteed to be without defect. However, we cannot guarantee that product descriptions, product images or any other content found in this website are accurate, complete or error free.

If at reception a product is found to be damaged or does not correspond to what was ordered, BB Education undertakes to exchange or refund it, including delivery charges, provided the product is returned in the original packaging along with the delivery notice, a copy of the invoice and within 30 days of the delivery date.

A customer who wishes to return a product for another reason may choose between an exchange, a credit note or a refund. The exchange must take place within the time period provided set out above. For the return of non-defective items, products must be returned in the original packaging along with the delivery notice and a copy of the invoice. Returns may be subject to a restocking fee of 15% to 50% depending on the stock conditions.

Customers must contact the BB Education Customer Service team at 514 273-9186 or 1 800 668-1108 prior to returning any merchandise. If product is eligible for refund, the Customer Service team will issue a Return Merchandise Authorization number. To be accepted, all returns must have an authorization number.

4. PRICE

Due to market fluctuations, our prices are subject to change without notice.

Catalogue prices do not include sales taxes, which will appear separately on your invoice.

All orders are payable in Canadian dollars.

5. TAXES

BB Education calculates taxes based on the delivery address. Orders can only be shipped to Quebec and New Brunswick. For Quebec orders, the QST (Quebec Sales Tax) and the Goods and Services Tax (GST) will be added. For New-Brunswick orders, the Harmonized Sales Tax (HST) and the Goods and Services Tax (GST) will be added. The Buyer hereby acknowledges that purchases must be made in a store for all tax exemption requests.

6. PAYMENT

Internet orders (www.bb.ca) are processed by our trusted partner Moneris.

Orders placed by phone, email, fax or regular mail can be paid by VISA or MASTERCARD or through your client account.

Orders must be paid in full in one payment at the time the order is placed.

For deliveries outside Canada, all customs charges and local taxes are the responsibility of the recipient.

7. DELIVERY

Terms of Delivery

A delay of 4 to 5 working days must be allowed for delivery in Quebec and Ontario (5 to 8 in the rest of Canada) when products are in stock at our warehouse. In no event shall BB Education be liable for late delivery caused by an inventory shortage or a carrier.

General Conditions of Delivery

Minimum amount to bill to your credit card or institutional account is $25.00. Shipping and handling charges are specific to each customer’s account.

For all orders of $25 and over billed to a personal credit card, shipping is $7.99 to all Canadian provinces (for delivery outside Canada, please contact our Customer Service).

However, additional delivery fees will be applied to Northern Regions and Remote Centres as defined by Canada Post. For those orders our Customer Service will contact you to confirm total shipping cost.

Certain items identified by the “truck” pictogram also have additional shipping charges. 9% of the item’s cost surcharge will be applied up to a maximum of $100 or $300 per order (depending on your province). Those charges are not added to any other fees.

When free delivery promotions are in effect, conditions for Northern Regions and Remote Centres as well as item surcharges are maintained.

8. LIMITATION OF LIABILITY

The Web site (www.bb.ca) and contents therein are supplied as is, without a guarantee of any kind, expressed or implied. While BB Education will do everything possible to ensure that bb.ca contains no errors, BB Education thereby declines any and all responsibility (subject to any applicable legislation in the province of Quebec to the contrary) related to the use, download, validity, accuracy or reliability of the elements that appear on the Web site (www.bb.ca). Its directors, employees, agents or customer service representatives shall not assume any responsibility, and in no event shall be liable for any damages directly or indirectly related to the use of bb.ca, including loss of data or profit resulting from the use of any information contained on bb.ca. In the event where you believe Brault & Bouthillier should be held responsible, it will be limited to the amount of money equivalent to the price you paid for the returned products. Notwithstanding the foregoing, nothing in this section shall be construed to limit any rights you may have as a consumer under any public order laws that may be applicable in your case.
